A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On December 24, 2017, the Defendant made a false statement to the effect that “Around December 24, 2018, the 2018 Highest 633, the Defendant would sell G H to the 140,000 won by visiting the victim to the Kakao Stockholm,” on the ground that “H will be sold to the 140,000 won of the middleest Gao Gao Gao Gao Ba” posted by the victim F.
However, since the defendant did not own the above Already, even if he received money, he did not have the intent or ability to send the above Already, and he used it for gambling or for the cost of living.
In addition, the Defendant: (a) by deceiving the victim as above; (b) stated the name of the Defendant in the name of the new bank account (J) in the name of the Defendant in the name of the bank account in the name of the Do payment account; and (c) received remittance of KRW 140,000 from around that time to March 13, 2018, the Defendant received the remittance of KRW 1,84,600 in total over 11 times, as shown in the attached list 1 of the daily crimes committed by the victim, from around that time.
On March 11, 2018, the Defendant made a false statement to the effect that “one Starbucks and bucks and 350,000 won will be sold to 140,000 won” by sending a written message to the victim K at a non-place, and to the “Skbucks and bucks and 350,000 won” posted by the victim K in the “Skbucks and bucks” page.
However, even if the defendant received the payment from the injured party, he did not have the intention or ability to send the exchange right, and he thought that it was used for the cost of living.
Around 12:53 March 12, 2018, the Defendant deceptioned the victim as above and acquired 140,000 won from the victim to the Kakao Bank Account (L) in the name of the Defendant.
The Defendant, on October 3, 2017, posted “Htp:/df.N.N.P” bulletin board located in NPC room located in the NAM 1st floor of Gwangju Mine-gu, Gwangju, on October 3, 2017.
