『2021 고단 16』 피고인은 2020. 8. 9. 경 피고인이 거주하는 평택시 Y, Z 호에서 인터넷 ‘AP’ 사이트에 ' 에어 팟 프로를 판매한다' 는 글을 게시한 후 이를 보고 연락한 피해자 IQ에게 AQ으로 ‘ 돈을 송금하면 에어 팟 프로를 판매하겠다’ 고 말하였다.

그러나 사실 피고인은 에어 팟 프로를 가지고 있지 않았으므로 피해 자로부터 돈을 받더라도 위 물품을 보내줄 의사나 능력이 없었다.

피고 인은 위와 같이 피해자를 기망하여 이에 속은 피해 자로부터 같은 날 에어 팟 프로 대금 명목으로 피고인 명의 AR 계좌( 번호: AS) 로 220,000원을 송금 받았다.

Accordingly, the defendant was given property by deceiving the victim.
