【범죄사실】 『2014고단1855』 피고인 A은 2009. 6. 24.경 경기도 구리시 인창동에 있는 대신증권 앞에서 피해자 D에게 “내가 알고 있는 희성선자(주) 회장으로부터 상장될 주식 600주(1주당 5,000원)를 매입하려고 한다. 300만 원을 주면 2009. 8. 25.까지 위 돈으로 매입한 주식을 매도하여 변제 하겠다”라고 거짓말을 하였고, 2009. 7. 2.경에는 "먼저 준 300만 원으로 피해자 소유의 주식을 샀다.
