1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff, including the part resulting from the supplementary participation.
Reasons
The plaintiff as the party to the decision is a school foundation that establishes and operates the D University (hereinafter referred to as the "university of this case"), and the defendant joining the defendant (hereinafter referred to as the "participating") was newly appointed as a full-time teacher on March 1, 2007 and was promoted as an assistant professor on March 1, 2010. From March 1, 2008 to February 28, 2010 and from March 1, 2013 to January 12, 2015, the plaintiff was employed as the head of the hotel management department.
On February 4, 2015, the president of the University requested the Plaintiff to take a heavy disciplinary measure against the Intervenor. Accordingly, the Plaintiff requested the instant teachers’ disciplinary committee (hereinafter “Disciplinary Committee”) to take disciplinary measures against the Intervenor. On March 19, 2015, the Disciplinary Committee decided to dismiss the Intervenor as follows.
Accordingly, the Plaintiff, as to the Intervenor on April 2, 2015, recommended a specific person to be employed in the course of new appointment as a faculty member of the second semester (hereinafter “former Disciplinary Reason No. 1”) on July 23, 2014 - Notwithstanding the fact that there was a day-time period of time when recommending hotel management and full-time faculty member (the answer by July 28, 201: the E Minister’s note : 28:00,00), the Plaintiff recommended a specific person to be employed as a specific person’s career and provision of specific qualifications before the public notice of appointment (hereinafter “former Disciplinary Reason No. 2”) - On July 23, 2014 (the first Disciplinary Reason No. 201:20:0:00, Nov. 22, 2014) to the E Minister and to be recommended by the E Minister on February 13, 2014 (the first Disciplinary Reason No. 2014:00, Feb. 14, 2014.).
