이에 따라 피고인들은 2012. 7. 10.경부터 2012. 8. 14.경까지 인천 F에 있는 ‘D’에서 G, H를 종업원으로 고용한 다음 게임물등급위원회로부터 등급분류 받은 ‘오션스일레븐’(등급분류번호 CC-NA-10094- 002)을 등급분류 받은 내용과 다르게, 최고점 아이템을 취득할 수 있는 거북이(포인트 1000점), 해마(포인트 2000점)의 출현빈도를 조작하여 위 아이템이 연속으로 출현하도록 하여 이용자의 능력과 상관없이 발사버튼 위에 자동진행보조장치(일명 ‘똑딱이’)를 올려놓고만 있어도 고득점을 획득, 경품(은 책갈피)이 배출되도록 개조된 게임물 50대를 손님 I 등 불특정 다수의 손님들에게 제공하였다.
