A defendant shall be punished by imprisonment for five years.

Punishment of the crime

1. Fraud against the victim C - The Defendant of Gwangju District Court 2014 High-Ma1508 came to know the victim C, who was the hospital employee, by drinking up the F working in the “Esanbu” located in Gwangju Mine-gu, and entering the said hospital.

As seen below, the Defendant only pays a large amount of interest to other victims by making a false statement that “to make an investment in and make profits from the employees of the Credit Union,” and did not have any intention or ability to make a full payment even if the Defendant borrowed money from other persons.”

Around March 8, 2011, the Defendant, at the six-story resting room of a hospital, concluded that “If he/she lends KRW 15 million to the victim, he/she will give KRW 2.5 million to the victim on a monthly basis, he/she shall not do so, and he/she shall do so.” The Defendant received KRW 10 million around March 8, 201, and KRW 5 million around March 31, 201.

Since then, from April 15, 201 to February 15, 2012, the Defendant knew of the victim by means of remitting the sum of KRW 2.5 million per month from April 15, 201 to the Gwangju Bank account (G) in the name of the victim, and received KRW 15 million from February 27, 2012, the Defendant received KRW 10 million around February 24, 201 and KRW 5 million from February 27, 2012.

On February 2, 2012, the Defendant stated that “If he makes a larger amount of money, he may lend money to him, and then create a total of KRW 300 million per three years per year. It is true that he has an apartment building. He borrowed this as collateral, he will lend the money. The interest on the loan will be paid in full.” The Defendant falsely stated that “I will create the mother as a father.”

In this regard, around March 2, 2012, the victim filed a total of KRW 53 million and KRW 15 million with credit loans, as security at the “Seongju Agricultural Co., Ltd. No. 1109-dong No. 101-dong No. 1109-dong No. 1010, Seogju-gu, Gwangju, the victim, at the 500,000,000,000 won in total.
