The plaintiff's claim is dismissed.
Litigation costs shall be borne by the plaintiff.
Reasons
1. Facts of recognition;
A. On December 30, 2016, the Plaintiff leased deposit amounting to KRW 50 million, monthly rent of KRW 179.645 square meters (hereinafter “the instant leased part”) on the fourth fourth floor among the Daegu-gu Office building D and E-ground buildings (hereinafter “instant building”) owned by C (hereinafter “instant building”), and paid KRW 50 million to C and KRW 50 million for the lease deposit period on August 31, 2020 (hereinafter “instant lease agreement”), and operated one Council member upon delivery of the instant leased part.
B. As to the instant building, the Defendant completed the registration of ownership transfer made on July 4, 2019 from Co., Ltd. on July 5, 2019 to the Defendant on April 17, 2019 and the F Co., Ltd. on July 4, 2019 in the future.
We (Defendant) purchased land and buildings for the purpose of constructing a main complex building including this site.
We inform us that we will no longer be able to engage in the lease contract, and other detailed matters are subject to the main time after consultation with us.
C. On July 8, 2019, the Defendant notified the Defendant that the ownership of the instant building was transferred to the lessee of the instant building, including the Plaintiff, and sent the following content certification (hereinafter “self-certification”) to the Defendant.
From around that time, when the Defendant’s director G terminated the lease contract to the lessee of the instant building before the expiration of the period, it proposed that the lessee pay KRW 1-20 million at the expense of the board of directors for each lessee. On August 5, 2019, the Plaintiff also proposed the same proposal.
Accordingly, the plaintiff is the defendant's "One hundred million won for Han-gu Council members, 150 million won for Han-gu Council members, 150 million won for director's expenses, 50 million won for director's expenses, 7 million won for uniforms, 3.8 million won for employees' monthly wages, 115 million won for operating losses, 50 million won for correcting subway advertisements, and 500,000 won for subway advertisements.
