On March 2015, the Defendants: (a) intended to attract unspecified men, who have put an advertising writing on smartphone-making fishing plates and reported and contacted with it, to have them do video-making (so-called 's body campaign'); and (b) intended to attract money by video-recording the appearance, and by threatening them to spread it to the visitors; (c) Defendant A leased the building 503 in the Seo-gu, Seo-gu, Seoan-gu, Seocheon-gu, Incheon; (d) purchased four Internet computers at that place; and (d) purchased 13 largephones to be used for committing the crime; and (e) ordered and manage all of the crimes against Defendant B and other accomplices; (d) Defendant B, C, and D posted a sign on the hosting pattern in compliance with Defendant A’s instructions, and led male and female accomplices to have a video-recording body known; and (e) intended to play a role in inducing them to video-recording and transmit the images to each other.

이에 따라 피고인들은 2015. 3. 12. 위 J건물 503호에서 스마트폰 채팅 어플 ‘즐톡’, ‘영톡’, ‘앙톡’에 ‘화끈하게 놀사람, 영상채팅 할 사람’, ‘재미있게 노실분’ 등의 광고글을 올리고, 이를 본 피해자 K에게 스마트폰 라인 어플로 대화를 신청하고 악성프로그램이 설치된 사진첩을 전송하여 피해자로 하여금 접속하게 함으로써 악성프로그램을 설치하여 피해자의 스마트폰에 저장된 전화번호, 문자메시지 내역 등을 전송받은 후, 미리 준비한 나체여성 동영상을 전송하여 피해자가 이를 보면서 화상채팅으로 자위행위 등을 하도록 유도한 후 그 영상을 녹화하였다.
