1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the disposition;

A. The Plaintiff is a company running the construction supervision business, etc., and the Defendant’s assistant intervenor is a company running the design and supervision business.

B. On March 20, 2017, the Plaintiff was selected as a person subject to the first priority examination on March 30, 2017, following the Defendant’s announcement of the recruitment of housing construction supervisors (hereinafter “instant recruitment announcement”) that was conducted to designate a supervisor of the construction of multi-unit housing (hereinafter “instant construction”).

The main contents of the criteria for examining the qualifications of supervisors, the qualifications for applying to supervisors, etc. as stated in the public notice of the recruitment of this case are as follows.

9. Qualification examination, designation, etc. of consulting engineers.

(a) Evaluation standards (i.e., evaluation standards) are assessed in accordance with the “Standards for Designation of Housing Construction Supervisors” under the Ministry of Land, Infrastructure and Transport Notice (2016-74, Feb. 25, 2016), and matters not specified in the said standards are 10. Consulting engineers’ qualification for subscription and examination criteria as of the basis of this public notice.

(b) A person who falls under Article 4(2) of the standards for designating a supervisor of housing construction work, and each item of Article 13(2) of the Enforcement Rule of the Housing Act, and who has completed basic education and specialized education under Article 42(2) [Attachment 3] of the Enforcement Decree of the Construction Technology Promotion Act, shall be a supervisor of another housing construction site as of the date of public announcement of recruitment, who is a supervisor of the overall construction site of another housing construction site as of the date of public announcement of recruitment, is not entitled to participate

(c) Time for calculating the period of examination standards for consulting engineers: The date of public announcement of recruitment of consulting engineers (including the date of public announcement of recruitment);

C. However, the defendant assistant intervenor selected as the person subject to the second priority examination defects in raising an objection as to the qualification of supervisor of the plaintiff, and the defendant's "the plaintiff" announced the recruitment of this case 10.B.

In violation of the Sheet C Multi-unit Housing Construction Corporation (hereinafter referred to as the "New Construction Corporation")

D designated as a supervisor of the project of this case, including a supervisor of the emergency project of this case.
