The grounds of appeal are examined.
The judgment below
Examining the reasoning of the lower judgment in light of the evidence duly admitted by the first instance court and the lower court, it is justifiable to have determined that the lower court convicted all of the facts charged in the instant case.
The lower court did not err in its judgment by exceeding the bounds of the principle of free evaluation in violation of logical and empirical rules, contrary to what is alleged in the grounds of appeal, or by misapprehending the labor standard law and the Act on the Guarantee of Workers’ Retirement Benefits, by misapprehending the legal doctrine on the intent to commit a crime of fraud, and the intent to commit a crime of defraudation.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
