1. The Defendant’s KRW 40,420,00 for the Plaintiff and the following: 5% per annum from May 7, 2013 to July 24, 2014.

1. Basic facts

A. The Plaintiff is a company established on November 19, 2012 for the purpose of building construction business, etc., and C is the husband of D, the representative director of the Plaintiff.

B. On September 8, 2012, the Defendant and C: (a) total construction cost of KRW 817,800,000,00 (including additional tax, additional tax, KRW 89,580,000, KRW 81,780,000, including KRW 817,800,000); and (b) construction period of construction from September 28, 2012 to January 10, 2013 (hereinafter “instant construction contract”).

c) The Plaintiff, Defendant, and C concluded a contract for the instant construction project with the Plaintiff from C to the Plaintiff. On November 22, 2012, the Plaintiff and the Defendant concluded a contract for the construction project from November 22, 2012 to January 31, 2013 (hereinafter “instant contract for the second construction project”).

(d) The Plaintiff concluded the instant construction on May 6, 2013. The Plaintiff completed the registration of initial ownership on May 16, 2013, and completed the registration of initial ownership on April 19, 2013 under the name of the Defendant. F new building was paid to the Plaintiff KRW 89,580,000 as the construction price of the instant case. The Defendant paid KRW 00,000 on October 10, 2012, KRW 00,000, KRW 30,000 on October 10, 200, KRW 30,000, KRW 10,000 on November 1, 200, KRW 200, KRW 16,000 on January 16, 200, KRW 3000 on May 10, 2003, KRW 30,000 on May 30, 2013

2. According to the above facts finding as to the plaintiff's claim, the defendant shall pay the remainder of the construction cost of KRW 40,420,000 (=total construction cost of KRW 940,00,000 - the fixed construction cost of KRW 899,580,00) and the fixed construction cost of KRW 89,580
