1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. The following facts may be acknowledged in full view of the descriptions of Gap evidence Nos. 1, 3, 4, and Eul evidence Nos. 2 through 4 and the purport of the whole pleadings.

On July 16, 2009, the Defendant entered into a lease contract with C on July 16, 2009, with a deposit of KRW 70 million, term of lease from September 5, 2009 to September 4, 2012.

B. After paying a security deposit to C, the Defendant completed a move-in report on the building indicated in the attached list on September 1, 2009, and resided from September 5, 2009, and obtained a fixed date in the instant lease agreement on December 27, 2012.

C. On January 9, 2013, the Defendant received a decision on the order of lease registration as Seoul Southern District Court 2012Kao24 on the attached list, and completed the registration of the housing lease on February 1, 2013 as Seoul Southern District Court No. 4738 on the attached list.

2. If so, the defendant shall be a genuine lessee who entered into a lease agreement with C as to the building listed in the separate sheet, and thus, the plaintiff's claim on the premise that the defendant is the most lessee shall not be accepted.
