A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 20, 2017, the Defendant posted a false statement to the effect that “The Defendant would sell the game machine in the face of remittance” to the victim D, who had contacted with the Defendant, by using a computer, connected to the PC room located in North Gun-si B prior to the end of October 2017.

However, the defendant, from the beginning, thought that he will receive money from the victim for the purpose of selling the game money, and did not intend or have ability to sell the game money even if he received money from the victim.

The Defendant, by deceiving the victim, received KRW 90,00 from the victim to the company bank account under the name of the Defendant on the same day from the victim, as the sales proceeds of the game money, and received KRW 1,195,200 from the victim to November 8, 2017 as stated in the attached list of crimes, in total, 14 times from the victims as the sales proceeds of the game money.

On April 5, 2018, the Defendant and E conspired to get the Defendant’s resident registration certificate reissued using a photograph of E in order to conceal the status of E in front of G in Gunsan-si F on April 5, 2018.

1. On April 5, 2018, the Defendant violated the Resident Registration Act: (a) the fact at the 2 Dong administrative welfare center located in the Sinsan-si Campaign, even though the resident registration certificate was not lost, the Defendant prepared an application for re-issuance of the resident registration certificate; (b) attached E’s photograph provided by E to the said application; and (c) submitted the said re-issuance application to H who is a public official in charge of issuing the resident registration certificate and received the Defendant’s application for issuance of the above E’s resident registration certificate

Accordingly, the Defendant conspiredd with E to apply for false facts regarding resident registration certificates.

2. The Defendant interfered with the performance of official duties in a deceptive scheme is a resident registration certificate at the time and place specified in paragraph 1.
