Defendant shall be punished by imprisonment without prison labor for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person engaging in driving a rocketing car.

On May 9, 2016, the Defendant driven the said car at a speed of 0:07 and driven the three-lane of “MG Saemaul Fund” in front of the “MG Saemaul Fund”, which is calculated at a speed of Flusing, led to the Defendant’s running of the said car at a speed of about 60km in speed, depending on one lane towards the “FG Saemaul Fund”.

그럼에도 불구하고 피고인은 이를 게을리 한 채 주변을 잘 살피지 아니하고 속도를 줄이지 아니하여 그대로 진행한 과실로 때마침 피고인의 위 승용차의 진행방향 좌측에서 우측으로 도로를 횡단하던 피해자 E(여, 68세)을 미처 발견하지 못하고 위 승용차의 우측 앞 범퍼 부분과 우측 보닛 부분으로 피해자를 충격하여 피해자로 하여금 그 충격으로 튕겨나가 바닥에 넘어지도록 하여 피해자로 하여금 다발성 장기 손상 등을 입게 하였다.

At around 20:48 on the same day, the Defendant caused the death of the victim who was receiving medical treatment in the emergency room of the Korean hospital in the Yeongdeungpo-si, Sinpo-si.

Accordingly, the defendant caused the death of the victim due to a traffic accident caused by occupational negligence.
