A defendant shall be punished by imprisonment for not less than eight months.

1. On December 13, 2006, the Defendant: (a) by deceiving the employees of the victim SK Telecom Co., Ltd., the Defendant: (b) received two handphones in a mobile phone agency located in Yongsan-gu Seoul, from the victim’s name and received two handphones in an amount equivalent to KRW 1,274,140; (c) obtained pecuniary benefits equivalent to the same amount as the Defendant did not pay 264,950 won to the said SK Telecom; and (d) acquired property benefits by receiving or paying the cost of using the mobile phone devices more than 10 times, such as in the attached list of crimes (Fraud).

2. Occupational embezzlement: (a) the Defendant engaged in I communication operated by the victim H in the Young-gu, Nowon-gu, Seoul Special Metropolitan City, as a sales employee; and (b) engaged in the sales of handphones and the receipt of payments.

On July 23, 2007, the Defendant opened Samsung mobilephone (W270) at the above store and received KRW 193,000 as the price, and embezzled the said price by arbitrarily using it at around that time.

In addition, from around that time to around February 23, 2013, the Defendant embezzled KRW 5,702,820 of the sales price and charges of handphones kept in the same way 14 times in total, as indicated in the attached list of crimes, from around that time to around February 23, 2013.

3. The Defendant, using the personal information, address, etc. of K known through the Internet hosting of a private document and the display of a private document, had a mind to use a Handphone in the name of K.

On February 18, 2009, the Defendant tested the LHandphone agency located in the Bupyeong-gu Incheon, Incheon, in the form of a contract for change in the name of the SKS mobile phone located in that place.
