A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant served as an employee at three mobile phone sales agencies substantially operated by the victim B and C from May 8, 2018 to April 14, 2019 (from May 8, 2018 to October 2018, he/she worked at the victim D large-scale store, from November 2018 to January 2019, in his/her personal business E from February 2019 to March 14, 2019, and from March 15, 2019 to April 14, 2019, he/she received mobile phone sales, mobile phone management, etc. from the victim F (one person G), and from March 15, 2019 to April 14, 2019.

1. On September 25, 2018, the Defendant embezzled the sum of KRW 13,307,100,00 of the victims’ money, while working at three mobile phone sales agencies in the same manner as shown in the attached Table 1, from around that time to March 27, 2019, while selling a Handphone to customer H while working at the store located near the Yeongdeungpo-gu Seoul Metropolitan City Dae Forest Station, and receiving KRW 1,360,700 from the Handphone to receive KRW 1,360,70 from the Handphone, and making a voluntary consumption of the victim’s living expenses, etc.

2. Embezzlement of proceeds from sales of used mobile phones;

A. On October 19, 2018, the Defendant, while working at the aforementioned victim victim D large-scale store, embezzled KRW 4,330,000 as shown in the attached Table 2 from October 19, 2018 to April 14, 2019 as well as for voluntary consumption of KRW 190,000,00, which was sold to a medium-sized mobile phone mobile phone dealer and used for the said victim’s business, from among those kept in custody for the said victim, the Defendant embezzled KRW 4,30,000 in total from among the victims’ possession of the mobile phone sales agent as shown in the attached Table 2.

B. Around January 2019, the Defendant is serving at the victim B and the above E agency in Yeongdeungpo-gu Seoul Metropolitan Government I.
