1. An executory exemplification of the Defendant’s Daegu District Court Decision 2014Kadan27231 against the Plaintiff.
Reasons
1. In fact, the Plaintiff received from the Korea Rail Network Authority a supply of and demand from the KRNA for the construction of the second Section Nowon-gu East-Yancheon Fire Relations Construction Project (hereinafter “instant construction”).
On October 23, 2012, the Simsan Industrial Development Co., Ltd. (formerly changed: wheel Wheelers, hereinafter referred to as "Simsan Industrial Development") entered into a subcontract with the Plaintiff and the instant construction, with the construction cost of KRW 15,221,80,00,00 for soil and sand, reinforced concrete and household facilities construction among the instant construction.
Since then, the development of the mountain industry did not submit a contract guarantee due to the aggravation of management while performing the construction work, and the plaintiff was terminated the subcontract on September 26, 2013 due to the failure to pay the debt to workers, equipment companies, material companies, etc.
On October 8, 2013, the Plaintiff notified the Korea Industrial Development Corporation of the construction cost of KRW 984,100,000, which occurred until termination of the contract.
As of August 31, 2013, the Plaintiff issued an electronic tax invoice of KRW 169,00,000,000, the amount of construction period amount of KRW 984,100,000, which occurred prior to the suspension of construction work for the industry development, and the amount of KRW 169,000,000, which was paid to the previous installment was the amount of KRW 815,10,000, which was the amount of KRW 167,943,00,000.
The defendant, a creditor of the domestic industry development, filed a lawsuit against the plaintiff for collection of the amount of 22,925,923 won and the amount of 20% per annum from June 21, 2014 to June 21, 2014. "The plaintiff (the plaintiff) shall pay to the plaintiff (the plaintiff) 22,925,923 won and the amount of 20% per annum from June 21, 2014 to the date of full payment."
