1. The Defendants are jointly and severally liable to the Plaintiffs in the “total” column of the claim and the total amount cited in the attached Table 3.
Reasons
1. Basic facts
A. The Defendants, as the parties, jointly entrusted the Korea Highway Corporation with the duty of collecting tollss from the Korea Highway Corporation, under the name of the business entity “BL” from March 16, 201. The Defendants are the employees of BL employed by the Defendants.
B. The Plaintiffs paid wages from the Defendants received allowances, such as the relevant monthly basic pay, bonus, etc., as stated in the “Items of Wage” in the attached Table 1. Extension Allowance, night work allowance, claim for holiday work allowance, and the cited statement.
The Defendants calculated ordinary wages solely based on the above basic wage. Based on the ordinary wage calculated as above, based on the Plaintiffs, each annual holiday allowance stated in the column of “term payment” among the pertinent monthly overtime allowance and night work allowance stated in the “regular payment” column in the pertinent monthly overtime work allowance, each of the pertinent monthly night work allowance specified in the “regular payment” column, and the pertinent monthly holiday work allowance specified in the attached Table 2, the claim for annual holiday allowance, and each of the “annual holiday allowance” column in the attached Table 2. The annual holiday allowance was paid.
(c) Article 54 (Definition of Wages) (2) of the details of the wage agreement and the rules of employment, wages during a period of which an employee has not actually worked, such as removal from position, suspension from office, temporary retirement, leave, leave, and sick leave, shall be unpaid, except as otherwise prescribed by these Rules;
Article 57 (Reward) (1) The annual rate of payment of bonuses shall not exceed 300%, but shall be paid based on the basic salary out of the monthly salary, and shall not be paid during the damp period.
(2) In principle, bonuses shall be paid four times a year (in April, August, September, and December), but they may be paid in equal installments on a monthly basis, depending on the conditions of the company.
(3) Where a retiree has worked for part of a period for payment of bonuses, he/she shall pay bonuses based on the daily calculation of such period for payment.
