Punishment of the crime

On February 2020, 2020, the Defendant received a proposal from the Defendant to transfer the money to an account under the name of the Defendant by misrepresenting the employees of the financial institution, and then conspired to withdraw the money received through the Defendant in cash, etc., and the Defendant accepted the proposal from the Defendant to the account designating the money of the Company to the account in the name of the Party’s name, and then newly opened the company bank account under the name of the Defendant.

However, on March 29, 2016, the Defendant was fully aware that the Defendant’s account under the name of the Defendant may be used for the so-called “stening account” for the so-called “stening crime,” on the grounds that “transfer of the e-mail card and its passwords to the Defendant’s account under the name of the Defendant” was a crime of violating the Electronic Financial Transactions Act.

Nevertheless, on February 13, 2020, the Defendant informed the account number of the company bank account in the name of the Defendant, and misrepresented the victim C with phone calls, and misrepresented the victim C with low interest rate loans. The Defendant provided the above company bank account in the name of the Defendant for the purpose of receiving transfer of KRW 20 million from the victim for the same day, and remitted USD 16,300 out of the amount of damage transferred to the above company bank account to the above company bank account to the F account in the name of E under the direction of the company scamcing organization.

Accordingly, the Defendant aided and abetted the victims to acquire money from the victim.
