A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On November 21, 2014, the Defendant was sentenced to four years of imprisonment for fraud, etc. at the Ulsan District Court and appealed, and is currently pending in the appellate court at the Busan High Court, and the president of the KK Cooperatives, an incorporated association.

On November 8, 2012, when preparing a joint development agreement for the stable supply of RPF (Reflued Plased Plas) production facilities and RPF for M business, the Defendant agreed to undertake the cost of the site and production facilities for the construction of RPF under the responsibility of the partnership. On April 30, 2013, the Defendant came to know that the financial intermediary in the amount of KRW 40 billion related to M business from HMC investment securities was impossible to receive a financial intermediary from HMC with the response of the intent of the financial intermediary with the three-month-term validity period, which can only be premised on the extension of the credit of the RPF, the contractor, and thus, it was difficult to normally proceed with the construction of RF-making facilities because it did not secure the cost of the purchase of land and production facilities.

Nevertheless, on July 30, 2013, the Defendant: (a) prepared a contract on construction works for new renewable energy production facilities, construction costs, construction period, construction period from September 1, 2013 to March 28, 2014 to the victim P (the 49-year old) who is the actual operator of N Co., Ltd. (the former O Co., Ltd.) in the factory office in the Seo-gu Incheon Metropolitan City, Seo-gu Industrial Complex; and (b) prepared a contract for construction works for new renewable energy production facilities at the same location; and (c) received an appraisal request from the victim as a credit assessment request; and (d) completed the contract for construction works for new renewable energy production facilities, and (e) received the appraisal request from the victim as a credit assessment request.
