A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
Around September 1, 2009, the Defendant, a salt company, entered into a construction contract with D operators E, who installed RPF boiler, etc., using waste vinyl as fuel, and entered into a construction contract with which E wishes to install RP boiler boiler in the Defendant’s company, and paid 325,000,000,000 won in total and in total, from the time on several occasions until January 22, 2010. Although the installation of the said boiler was completed on or around December 2009, the Defendant was notified of non-permission of installation of boiler from the Governor of the Gyeonggi-do around April 16, 2010, the Defendant changed the contents of the said contract to E operators’ name with a view to not paying 115,00,000,000 won.
On February 6, 2013, the Defendant added “4. B” to “(4. B) authorization and permission, completion of construction work, and remainder after the trial run,” and attached one copy of the revised construction contract to E(1) as if it were duly constituted on February 6, 2013, at the post office located in 1318, the Defendant sent to E a copy of the revised construction contract to the Defendant’s employees on the following: (a) around February 6, 2013, the Defendant’s seal was stamped; and (b) around February 6, 2013, at the office located in 1318, the Defendant issued the revised construction contract to E by mail.
Accordingly, for the purpose of exercising authority, the Defendant modified the F’s contract for construction work in the name of F, a private document concerning rights and obligations without authority, and exercised it by sending a copy of the modified contract for construction work to E.
