1. The plaintiff (Counterclaim defendant)'s main claim is dismissed.
2. The Plaintiff (Counterclaim Defendant) is KRW 16,00,000,000 against the Defendant (Counterclaim Plaintiff).
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. On January 14, 2011, the Defendant entered into a non-payment protocol, 100 years old health insurance108 (hereinafter “instant insurance”) with the Plaintiff as the insured.
According to the special agreement of the insurance contract of this case to which the Defendant subscribed, the purchase price of cancer diagnosis costs is KRW 20,000,000.
B. The relevant provisions of the instant insurance contract are as follows.
1. The type and cause for the payment of insurance money (1) If the insured described in the insurance policy (hereinafter referred to as the “insurance period”) is diagnosed with cancer, thothothothothothothothothotho, nethothothothothothothotho, althothothothothothotho or cancer after the date of commencement of coverage during the insurance period
Under 1 year from the date of insurance contract (one time) for 20% cancer diagnosis costs (one time) of the purchase amount of insurance under this Special Terms and Conditions: 50% from the date of insurance contract amount of this Special Terms and Conditions: 10% of the purchase amount of insurance under this Special Terms and Conditions: 10% of the purchase amount of insurance under this Special Terms and Conditions;
3. In terms of the definitions and diagnosis determination of “Aams”, “other skin cancer”, and “Aams”, the term “ams” in this Special Terms and Conditions refers to the diseases specified in the classification table of malicious life (see Table 6, e.g., the classification table of malicious life (Aams).
However, it does not include diseases falling under the condition of Jeonam (pre-almalgant, marant marant, C44 and C73.
