Reasons
Punishment of the crime
1. A person who intends to engage in credit business in violation of the Act on Registration of Credit Business, etc. and Protection of Financial Users shall file for registration of credit business with the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Metropolitan City Mayor, or a Special Self-Governing Province Governor, who has jurisdiction over the relevant place of business, and if any unregistered credit service provider runs
A. B, without registering a credit business with the competent authority on February 19, 2018, the Defendant leased KRW 2 million (1.8 million for the actual payment after deducting KRW 200,000 as a prior interest) from the coffee specialty point at which Jin-si, Jin-si (hereinafter referred to as “Gin-si”), and received interest exceeding the statutory maximum interest rate as shown in attached Table 1, from March 18, 2018 to November 20, 2018, from March 18, 2018.
B. C-related Defendant, without registering a credit business with the competent authority on April 27, 2018, lent 2 million won (1.8 million won for the actual payment after deducting 200,000 won as a prior interest) to C at a point where the address is not infinite, Jinju-si, and received interest exceeding the statutory interest rate, as shown in attached Table No. 2, from June 2, 2018 to November 4, 2018, upon receiving a total of seven times as shown in attached Table No. 2, from around June 2, 2018 to receiving a total of KRW 1,400,000 from around November 2, 2018.
C. D related 1) The Defendant, without registering his credit business to the competent authority on April 16, 2018, received KRW 2 million from the coffee specialty store located in the address of Dobong-dong (hereinafter referred to as “Seong-dong”), Jin-si, J. 200,000 (the actual payment after deducting KRW 200,000,000 as the interest interest rate) from May 16, 2018 to November 20, 2018, with a total of KRW 1,30,000,000 from May 16, 2018 to July 3, 2018, and operates the unregistered credit business, and the maximum legal interest rate.
