A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
On July 6, 2016, B, the Defendant’s spouse, entered into a contract for a term deposit of KRW 30 million (Account Number: E), a contract for a term deposit of KRW 70 million (Account Number:F) and a term deposit of KRW 70 million (Account Number).
1. On September 12, 2016, the Defendant: (a) without obtaining the consent of the said B on September 12, 2016, the Defendant entered a loan application for a term deposit of KRW 30 million (Account Number: E) to obtain a loan as collateral at the above D D D D D branch; (b) stated B’s resident registration number and address in the Personnel Information column; (c) stated B’s resident registration number and address in the name column of the debtor-related person’s confirmation document attached to the said application; (d) affixed the Defendant’s seal on the back, and submitted it to the employees in charge of the above D D branch.
For the purpose of uttering, the Defendant forged a copy of a private document B, which is a private document related to rights and obligations, and exercised it.
2. On December 12, 2016, the Defendant, who committed the crime of December 12, 2016, did not obtain the said B’s consent with respect to the cancellation of the term deposit that was opened at the above D D D D D D’s establishment, but prepared a deposit claim amounting to KRW 20 million in order to terminate the term deposit amounting to KRW 70 million even if part of the term deposit amount (Account Number:F), and signed and sealed the Defendant’s seal on that side, and submitted it to the said D’s employee.
As above, the Defendant repaid the above security loans of KRW 20 million as to the term deposit (Account Number: E) with the above KRW 30 million which has been terminated even in some middle of the terms as above.
In order to continue to terminate the term deposit amounting to KRW 30 million (Account Number: E), the Defendant prepared a written request for deposit amounting to KRW 30 million and entered “B” in the name column, affixed the Defendant’s seal on the side and affixed it to the said employees.
