The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal that the court below rendered against the defendant (3 million won of a fine and 40 hours of sexual assault treatment programs) is too unfluent and unfair.

2. In full view of the facts charged by the Defendant, as well as other circumstances that form the conditions for sentencing indicated in the record, such as the Defendant’s age, environment, occupation, family relationship, background leading to the instant crime, and circumstances after the commission of the crime, the lower court’s sentence is deemed unreasonable.

3. In conclusion, the prosecutor's appeal is without merit, and it is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
