1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition of the disposition, etc.;
A. On October 1, 2013, the Plaintiff: (a) received a contract for construction work from the Republic of Korea (No. 5326 unit); (b) 168,481,200 won; (c) on October 7, 2013, the date of commencement; and (d) on December 20, 2013, “B” (hereinafter referred to as “instant construction; and (c) received a contract for completed construction works (hereinafter referred to as “instant construction”); (d) October 25, 2013; and (e) completed the instant construction in C Co., Ltd (hereinafter referred to as “C”) (hereinafter referred to as “C”); and (c) completed the instant construction on December 18, 2013.
B. The Ministry of National Defense conducted an audit of the instant facilities from March 9, 2015 to March 13, 2015, and notified the head of the Air Force Headquarters of the following audit results:
The design drawings of the instant construction are designed to be distributed at intervals of 200 meters, respectively, with the strength of ammunitions and sludges 21MPa, and the interior steel bars are designed at intervals of 200 meters x 200 meters and 150 meters x 150 meters.
C subcontracted a reinforced concrete construction among the instant construction, was found to have been illegally shipped out without using approximately 12 tons of the steel bars of 30 tons, a design quantity, and thereby, the inner steel bars of the wall and slve respectively, as listed below, was confirmed to have been distributed in fluorously at intervals of 260m x 305m x 266m x 300m m.
