A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is a person who is engaged in driving a Crane car.
1. Around 00:20 on April 4, 2015, the Defendant driven the said car while under the influence of alcohol content of about 0.124% from the 4km section from the front of the Yannam-ro, Incheon, Seo-gu, Incheon, Seo-gu, to the front road of the Yancheon-gu, Incheon, Seo-gu, 514.
2. A violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) was driven on April 4, 2015 by the Defendant, around 00:30 on April 4, 2015, driving the said car, and driving on the road of five lanes in front of the said North Incheon Incheon National Office of Registration at the speed of about 40km from the vicinity of the mountain valley to the distance of the Bupyeong-gu Office building.
In such cases, a person engaged in driving of a motor vehicle has a duty of care to safely operate and proceed the steering and brakes while ensuring the distance from which it can well see the front side and avoid the collision with the motor vehicle ahead.
Nevertheless, as stated in Paragraph 1, the Defendant neglected to drive an electric-time vehicle while under the influence of alcohol and operated brates. However, due to the negligence that operated the accelerator, the Defendant was driven by the victim D (the age of 48) who was parked in order to give signals at the three-lanes. The Defendant was placed in front of the vehicle driven by the victim D(the age of 48) who was parked in order to give notice to traffic at the three-lane, due to the shock, the said car was pushed in the future, and the said car was driven by the victim F (the age of 63) who was parked in the front, and the vehicle was driven by the victim F(the age of 63) who was parked in the front, due to the shock, and the vehicle was driven by the victim H(the age of 38) who was parked in the front, and the vehicle was driven by the victim D(the age of 38).
