A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant received a fine of KRW 1 million on November 25, 2016, for the crime of property damage, from the capital support of Suwon Friwon on November 25, 2016, and from September 1, 2016, a fine of KRW 2 million on September 1, 2016, respectively.

[Criminal facts]

1. On November 14, 2016, the Defendant: (a) sexual intercourses with the “E” restaurant operated by the victim D in Ischeon-si, Gyeonggi-si on November 17:10, 2016; (b) sexual intercourses with the victim’s “E” restaurant that requires an order for drinking and food and then makes it available to the victim; and (c) sexual intercourses with the victim that “I would see, die, and die,” and caused the victim to interfere with the victim’s restaurant business by force for about one hour.

2. A special intimidation: (a) the Defendant laid a scam at the time and place specified in paragraph (1) at the above time and place, by gathering concrete block, which is a dangerous object around the scambling the Defendant outside of the restaurant, with the Defendant’s view to walking with the entrance door of the restaurant, and then scambling the victim with the view to the Defendant, and then threatening the victim as if the block used in the scam, scambling, and scam, with the victim’s view to leaving the entrance, and then threatening the victim, such as leaving the block out of the entrance.

At around 16:20 on the same day, the Defendant: (a) sought a cell phone from the above restaurant with I’s aid; (b) returned to G in front of the entrance; and (c) expressed that he was requested by the above I to return home from G; and (d) opened the rank by putting the right shoulder part of the above I with his hand, and pushed the chest of the above I in both hands.
