1. Basic facts

A. The Plaintiff is an insurer running non-life insurance business, such as automobile comprehensive insurance.

The Plaintiff concluded a comprehensive automobile insurance contract with D, the owner of the instant vehicle C (hereinafter “instant vehicle”), with the instant vehicle as the subject matter of insurance.

B. The Defendants, around 03:10 on May 1, 2014, around 03:0, passed through the front delivery of the 1st floor F cafeteria of the building in Seongbuk-gu, Sungwon-gu, Sungwon-si. In the instant case, the Defendants put their body on the body fighting.

In order to witness and spawn the situation in which Defendant A was spawn, the other party to Defendant B’s spawn spawn, and spawn spawn spawn to another place. Defendant A spawn spawn of the instant vehicle, which had been spawned, exceeded the Defendant B with Defendant B.

The Defendants were indicted for the crime of causing property damage to the instant accident.

On June 10, 2015, the court of first instance sentenced the Defendants to a fine of one million won each.

In light of the fact that the Defendants appealed on November 26, 2015, and the appellate court: (a) as the Defendants were flicked in a fighting match; and (b) the Defendants flicked on the blicks of the instant vehicle; and (c) Defendant A flicked Defendant B at first, Defendant B flicked its own part; and (d) both Defendants flicked with the vehicle blicks of the instant vehicle when the Defendants flicked with the said blicks of the instant vehicle; and (b) the Defendants intentionally flicked the blicks of the Defendants.
