1. The Defendants shall jointly and severally pay to the Plaintiff KRW 150,000,000 and the interest rate thereon from June 27, 2014 to the date of full payment.

1. Basic facts

A. The Plaintiff is a juristic person established for the purpose of separate collection and transportation of recycling, and the Defendant A (hereinafter “Defendant A”) is a juristic person established for the purpose of printing and production, etc., the Defendant B is a representative director of the Defendant Company, and the Defendant C is a person who actually operates the Defendant Company.

나. 원고는 2013. 10. 10. 피고 회사와 사이에 원고가 피고 회사에 예치금(계약서상 ‘파지보증금’이라는 용어도 혼용하고 있다.) 5억 원을 지급하되 2013. 10. 14.부터 2015. 10. 13.까지 피고 회사의 공장에서 발생하는 파지(破紙)를 수거하기로 하는 내용의 재활용품매매계약을 체결하였는데, 위 예치금 5억 원 중 3억 5,000만 원은 원고가 이노필프린테크 주식회사(이하 ‘이노필프린테크’라 한다.)에 대한 보증금반환채권을 차후 양도하여 주는 것으로 대체하고, 나머지 1억 5,000만 원은 2013. 10. 14.까지 피고 회사에 지급하기로 하였다

The terms and conditions of the above contract for the sale of recycled products are as follows:

Article 4 (Terms of Contracts)

3. 500 tons per annum for the collection of land shall be collected free of charge.

4. As for the amount of additional generation exceeding 500 tons a year, 180 won per kilogram shall be calculated in 180 won per annum, and the security deposit for strike shall be deducted.

Provided, That when 500 tons per annum are known, the defendant company shall calculate 180 won per kilogram for the shortage quantity and pay it to the plaintiff.

On the other hand, Defendant B and C guaranteed the obligation owed by the Defendant Company to the Plaintiff in relation to the said contract on the same day.

In addition, in order to secure the obligation to refund deposit amounting to KRW 500 million on the same day, the Defendant Company: ① the Defendant Company intended to purchase the total amount of KRW 700 million from D from D, and ② the Jono Wireless System (Attached Nos. 1 through 5; hereinafter “this case’s system”).
