Defendant shall be punished by a fine of KRW 10 million.

Reasons
Punishment of the crime
On May 8, 2015, the Defendant was sentenced to three years of imprisonment for fraud, etc. at the Busan District Court, and the judgment became final and conclusive on January 14, 2016.
The defendant is a pastor, and the victim C borrowed a considerable amount from the injured party as the head. On the other hand, the defendant was suspended from detention on March 26, 2012 while he was tried by Busan District Court as a case related to the injured party.
1. On September 24, 2013, the Defendant: (a) in E operated by the victim C in Ulsan-gu D on September 24, 2013, “The real estate issues in the trial at the discount of a bill will also be resolved; and (b) will also be partly resolved through the bill.
“Issue” means the issuer: FSC representative director, payment place (ju), Korea Cit Bank, amount of KRW 55,000,000, and Promissory Notes number G.
However, the above bill was not possessed as a normal transactional relationship, but it was known that the bill purchased through H was a bill with a considerable amount of KRW 10 million and that the Defendant would not pay it on a normal payment date, and that this part was not notified to the victim.
Accordingly, the Defendant, by deceiving the victim who was aware that the said bill was a normal bill, received 37,000,000 won from the Agricultural Cooperative Account in the name of I on the same day as the bill discount.
2. On Oct. 1, 2013, the Defendant issued a request from the victim C to “a bill is the same as a bill which is convenient prior to the payment of the closing price.” At the same place, the Defendant suggested that “The issuer: J, the place of payment: The Nong Bank; the date of payment; the Nong Bank; the Nong Bank; the date of payment; the Nong Bank; the amount of KRW 30,000,000 at face value; and the serial number of the bill: K, which is a bill that is based on legitimate transaction; and “K will use the bill by dividing KRW 15 million.”
