A fine of KRW 1,00,00 shall be imposed for the crimes of KRW 1,60,00, which are set forth in the judgment of the defendant.
Reasons
Punishment of the crime
The Defendant, up to September 2012, 2012, has a dispute over the interpretation and implementation of the transfer contract (the transferor Defendant and transferee G) with respect to the said postnatal care center concluded as of September 24, 2012 with the victim G.
1. On February 4, 2013, around 15:20, the Defendant: (a) discovered as a postnatal care center; (b) entered a newborn baby room; and (c) laid down from October 1, 2012 to October 1, 2012, the said victim, who was the victim’s possession, was in his/her custody; and (d) stolen the said victim, with a new birth record sheet, a maternity record sheet, and a entry record sheet.
2. On February 5, 2013, at around 14:20, the Defendant: (a) sought to find as a postnatal care center on February 5, 2013, and (b) sought to attach a printed object called “emergency notice” inside a postnatal care center; (c) when the said victim (the age of 48), followed the victim’s arms to put them into a laundry room, thereby committing assaulting the victim to put them into a laundry room, thereby requiring approximately two weeks of treatment.
3. On February 25, 2013, the Defendant: (a) discovered as a postnatal care center on or around 14:20 on February 25, 2013; (b) sounded that “inwards will be deducted; and (c) destroyed the front part of the air conditioner to be cut down in the part owned by the said victim; and (d) damaged 30,000 won by setting up the telephone machine installed therein on the floor so as to cover the repair cost.
4. On March 7, 2013, the Defendant: (a) made a false report to the effect that “the Defendant is making an illegal marina in F Postnatal Care Center” by posting a phone at a place where the location cannot be known; (b) the police officer and the public official in charge who received the report is called to the aforesaid Postnatal Care Center and confirming whether the Defendant is conducting illegal marina business at the said place; and (c) thereby operating the Postnatal Care Center by deceptive means.
