On July 8, 2019, around 21:31, 2019, the Defendant: (a) received a report that “a person under the influence of alcohol is under the influence of alcohol”; (b) received a request to present identification from the police officer D in charge of the police box of the Chungcheongnamnam Police Station; and (c) rejected it; (d) was under the influence of alcohol, and (e) was accompanied by the police box of the said police box to board the patrol boat on his own.

피고인은 같은 날 21:00경 충남 보령시 F에 있는 충남보령경찰서 C파출소 주차장에 도착한 뒤, 위 폭행과정에서 다친 손가락 치료를 위해 119 구급대를 불러달라고 요청하여 이에 위 순경 E이 119 구급대에 지원을 요청하였고, 구급요원을 기다리면서 위 경위 D로부터 신원확인을 위해 인적사항을 말해달라는 요청을 받았음에도 이를 거부하며 ‘씹새끼, 개새끼’ 등 수차례 욕설을 하는 등 소란을 피워 위 D가 '119가 올 때까지 기다려달라'며 피고인을 제지하자, “짭새 새끼들 다 죽었어! 좆까 씹새끼야”라고 욕설을 하고 양손으로 위 D의 가슴부위를 1회 밀치고, 양손으로 D의 멱살을 잡았다.
