A fine of three million won shall be imposed on a defendant.

Where the above fine is not paid, one million won shall be converted into one day.

Punishment of the crime

1. 특정범죄가중처벌등에관한법률위반(운전자폭행등) 피고인은 2013. 12. 17. 23:00경 구미시 B에 있는 C식당 앞 도로에서 동거녀 D과 함께 피해자 E(53세) 운전의 F 개인택시에 승차한 후 구미시 G에 있는 H 앞 도로에 이르러 D과 말싸움을 하다가 피해자에게 실내등을 끄라고 하였으나 위 택시를 운행 중인 피해자가 늦게 껐다는 이유로 화가 나, 피해자의 우측 어깨를 발로 1회 걷어찼다.

Accordingly, the Defendant committed assault to the victim who is operating an automobile.

2. 재물손괴 피고인은 제1항 기재와 같은 일시, 장소에서 실내등을 늦게 껐다는 이유로 피해자를 폭행한 후 피해자가 차량을 정차시키자 차량에서 내리면서 발로 피해자 소유의 택시 우측 뒷문을 발로 걷어차고, 그 후 피해자의 멱살을 잡고 시비하는 과정에서 피해자가 도망치자 재차 택시 우측 앞문을 발로 걷어차 수리비 315,366원 상당이 들도록 손괴하였다.
