Reasons
Punishment of the crime
The defendant is the representative of the AG Hospital located in Suwon-gu, Suwon-si, who operates a hospital with 130 full-time workers.
Defendant 2, “2014 Highest 6867,” had worked at the said workplace from January 2, 2014 to September 26, 2014, and from September 2014, 2014, the total amount of wages of 38 million won for workers AH, and 9. The total amount of wages of 5,342,81 won for workers, who worked from January 20, 2010 to June 27, 2014, as described in paragraph (1) 1, 2,4, 6, 7, 9, 10, and 11, did not pay eight wages or retirement allowances of 8 workers within 14 days from the date of retirement without an agreement on the extension of the payment date between the parties concerned.
Defendant AJ’s wages of 305,424 won and retirement allowances of 2,950,07 won, which were employed from April 22, 2013 to September 1, 2014 at the same place of business, were not paid within 14 days from the date of retirement without agreement between the parties on the extension of the payment date of the annual paid leave, as stated in attached Table (2) 2, 3, 4, 5, 7, 9, 10, 11, 12, 15, 18, 20, 20, 21, 30, 31, and 32.
Defendant 1-29, 31, 32, 33, 35, 36, and 37 of the Schedule of Attached Crimes (3) including 1-29, 31, 32, 33, 35, 36, and 35 workers’ wages, annual paid leave allowances, or retirement allowances, from November 6, 2013 to December 13, 2014 at the same place of business, paid 1-29, 35 workers’ wages, annual paid leave allowances, or retirement allowances, within 14 days from the date of retirement without agreement between the parties on the extension of the due date.

A. From January 13, 2014 to November 1, 2014, the Defendant violated the Labor Standards Act: (a) the amount of KRW 5,00,000 paid-in wages of August 2014; (b) the amount of KRW 12,00,000 paid-in wages of September; (c) the amount of KRW 12,00,000 paid-in wages of October; and (d) the amount of KRW 31,709,677 paid-in wages of November 2, 2014, without agreement between the parties on the extension of the payment date.
