피고인은 2013. 3. 12. 04:00경 지능지수 58, 사회성숙지수 62.4로서 자조능력, 작업능력, 이동능력, 사회화 능력 및 의사소통 능력이 10세의 아동 수준인 지적장애 3급의 장애인으로서 위와 같은 지적장애로 인하여 의사표현능력 및 상황에 대한 대처능력이 부족한 위 피해자를 강간할 것을 마음먹고, D가 잠이 든 것처럼 보이자 위 피해자에게 접근하여 소리가 밖으로 새어나가지 않도록 TV를 켠 상태에서 피해자의 옷 안으로 손을 넣어 가슴을 만지면서 피해자에게 입을 맞춘 후 피해자의 하의를 벗기고, 이에 하지 말라며 손으로 피고인을 밀어내는 피해자의 양손을 잡아당겨 피고인 위로 앉힌 후 몸을 뒤로 빼는 피해자의 양손을 잡아 끌어 도망가지 못하게 한 상태에서 피해자를 1회 간음하고, 화장실에 다녀온 피해자에게 다시 접근하여 소리를 지르려는 피해자의 입을 막은 후 피해자의 양팔을 잡아 누르면서 피해자의 몸 위로 올라타고 허벅지로 피해자의 다리를 눌러 움직이지 못하게 한 후 피해자를 1회 간음하여 피해자에게 치료일수 미상의 처녀막 손상을 입게 하였다.
