A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 22:51 on August 22, 2020, the Defendant driven a DNA car, which is owned by the Defendant, under the influence of alcohol alcohol concentration of about 3km from around 0.158% to around 0.158%, from around the seat of the land located in Yeonsu-gu Incheon Metropolitan City B to the place of the accident described in paragraph (2).
2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Risk Driving) is a person engaged in driving the said D Car.
Around 22:51 on August 22, 2020, the Defendant: (a) driven the Karen car at the Scene Intersection located in Namdong-gu Incheon Metropolitan City, and passed through the intersection from the long-distance outflow of the route hospital to the long-distance outflow of the route hospital; (b) the Defendant was driving a HP car in the front part of the Karen car, which was driven by the victim E (Nam, South, 30 years old) who was driving in the opposite direction and stopped across the median line due to the influence of drinking, such as that described in paragraph (1), while driving the Karen car at the long-distance intersection located in the south-gu Incheon Metropolitan City, Seoul; (c) while driving the Karen car, which was driven by the victim G (Seoul, and 50 years old) who stopped after the said Karen car, left the front part of the 2nd PP car and left the 3nd part after the said Kamil.
As such, the Defendant, while driving the said car in a situation where normal driving is difficult due to influence of drinking, caused a traffic accident to the victim E, who is the driver of the said car, and suffered an injury to the victim E, which requires approximately two weeks of medical treatment, such as a fladr’s fladr’s fladr’s fladr’s fladr’s fladr’s fladr’s fladr’s fladr’s fladr’s fladr’s fladr’s fladr’s b
