Reasons
Punishment of the crime
[criminal history] On June 5, 2014, the Defendant was sentenced to one year of imprisonment for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Gwangju District Court, and the period of parole passed on March 30, 2015 during the execution of the sentence at the Ganpo Prison.
[Criminal facts]
1. The Defendant: (a) knowingly aware of the fact that, while aiding and abetting special larceny, aiding and abetting special larceny; (b) aiding and abetting special larceny; and (c) aiding and abetting and aiding and abetting at night upon intrusion upon residence, in passage through the Republic of Korea; (d) by destroying only abandoned houses by using a ductos (tentative name) and cutting machines; and (d) intrusion upon only abandoned houses at night, and thereby preventing the theft by carrying precious metal, etc. located therein; (d) by driving a Flearning car around July 14, 2016, around 18:30 on the same day, he easily moves from Y to Cheong-si, and entered the front door of the said house in the middle of 307 Dong 902, which is the house of the victim G located in the same Gu, into the victim’s house; and (d) by entering into the victim’s house in the middle of 16:00,000 won and more than the victim’s market price; and (d) made it easier from 16:6:15th of the same day.
2. On May 20, 2016, the Defendant: (a) received a request from E to sell precious metals, such as double-rums, etc. owned by a person who was stolen by him from E in the vicinity of Sinpo-si on May 20, 2016; and (b) received and sold KRW 2,716,00 from “J” located in Sinpo-si I on the same day with knowledge that the said precious metal is stolen; (c) during the period from around that day to August 24, 2016, the Defendant assisted the transfer of stolen goods by selling the precious metal of KRW 31,061,50 in total seven times, such as the list of crimes in attached Table 2, from around that day to around August 24, 2016.
