A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

On July 11, 2014, the Defendant posted a letter “I sell game money or items” on an online game site (http://ab. Plac.com) and sold game money to C to the victim who reported and contacted with the Defendant.”

However, there was no intention or ability to sell game money or items.

As above, the Defendant received 100,000 won from the victim to the Defendant’s agricultural bank account from the victim, and acquired it through deception from February 28, 2015, and received 1,908,000 won in total from 30 members, as shown in the attached Table 1, from February 28, 2015.

Around April 18, 2014, the Defendant posted a letter stating that he/she sells online game money in a PC room (http://ab.Plac.com) by linking the Internet game ion (htp.//ab.P.C.com) with the trade name in Ulsan-gu, Ulsan-gu.

However, even if the defendant receives money, he did not have the intention or ability to sell the game money.
