Reasons
Punishment of the crime
1. Defendant A and B, in violation of the National Sports Promotion Act, conspiredd to operate a sports earth site and to engage in similar sports promotion voting activities against many unspecified persons. On March 29, 2016, Defendant B leased a room located in Incheon ro-Gun, and joined the Internet service in the name of Defendant B at the above place around the same month. At around that time, Defendant B opened a similar sports earth site in which sports promotion voting activities are conducted by requesting a “E”, an illegal sports earth site, such as a axis, deaf-gu, and camping district, to predict the outcome or points of the domestic and overseas sports competition, and paying dividends to those who correctly predicted the outcome.
In addition, Defendant A sought a large phone and a borrowed account used for operating the above sports earth site from around that time, and advertised the above sports earth site via the Internet, and Defendant B used the above borrowed name account from many unspecified users during that time to July 2016, thereby receiving money or refunding dividends from the above sports earth site.
In addition, around May 2016, Defendant C received proposals from the above Defendants to accept the same defect as the above-mentioned similar sports promotion voting act. From around that time to July 2016, Defendant C used the above borrowed name account from an unspecified number of users at night to transfer money or refunded dividends.
Accordingly, the Defendants conspired to produce a system that issues sports promotion voting rights or similar through information and communications networks from the end of March 2016 (from May 2016 to July 2016 to provide them to the public for use.
2. Defendants violating the Electronic Financial Transactions Act are committing the crimes set forth in paragraph 1.
