1. The plaintiff's appeal is dismissed.

2. The costs of appeal shall be borne by the Plaintiff.

The judgment of the first instance is revoked. The defendant shall pay to the plaintiff 29.933,847 won and 20% interest per annum from the day following the delivery of a copy of the application for modification of the purport of the claim as of August 19, 2014 to the day of complete payment.

The reasoning for this Court’s explanation is as stated in the reasoning of the judgment of the court of first instance, except for the evidence which is insufficient to admit the Plaintiff’s assertion as to the Plaintiff’s assertion, since the reasoning for this Court’s explanation is the same as that of the judgment of the court of first instance pursuant to Article 420 of the Civil Procedure Act.

2. Conclusion

Therefore, the plaintiff's claim of this case shall be dismissed as it is without merit, and the judgment of the court of first instance is just, and it is so decided as per Disposition.
