Reasons

1. Summary of grounds for appeal;

가. 사실오인 1) 이메일 발송에 관하여 피고인이 2012. 11. 14.경 E에게 이 사건 공소사실 기재와 같은 이메일을 보낸 것은 사실이나, 위 이메일은 발신인이 “A(피고인)”으로 명시되어 있어 그 수신인인 E이 착오를 일으킬 리 없고, 그 내용은 담당자였던 피고인이 퇴사한 것을 통지하려는 취지였으며, 위 이메일의 말미에 “(주)D”라고 기재된 것은 피고인이 위 회사에 재직할 당시 자동적으로 이메일의 말미에 추가되도록 한 “꼬릿말 서비스”에 의한 것일 뿐으로, 피고인에게는 피해자 주식회사 D(이하 ‘피해자 회사’라고 한다
