1. Basic facts

가. 이 사건 심결의 경위 1) 원고는 2017. 9. 18. 아래 나.항 기재 이 사건 특허발명의 특허권자인 피고들을 상대로 특허심판원 2017당2958호로 이 사건 특허발명의 청구항 1, 2, 3, 5, 6, 7에 대한 특허무효심판을 청구하고, 그 심판절차에서 ‘위 각 청구항은 비교대상발명 1 내지 3 비교대상발명 1은 이 사건 소에서 선행발명 9로 제시되었다. 한편 비교대상발명 2는 2006. 10. 19. 공개된 미국 특허공개공보 제2006/023884호에 게재된 ‘마유(馬乳)로부터 추출된 성분을 포함하는 성 위생 조성물(sexual hygienic composition)’에 관한 발명이고, 비교대상발명 3은 2009. 2. 5. 공개된 미국 특허공개공보 제2009/0035361호에 게재된 ‘유효성분으로 호프(Humulus lupulus)를 포함하며 질건조증(위축성 질염)에 유용한, 질에 사용하기 위한 조성물’에 관한 발명인데, 이들 발명은 이 사건 소에서 선행발명으로 제시되지 아니하였다. 에 의하여 진보성이 부정되고, 이 사건 특허발명은 명세서 기재요건을 충족하지 못하였으므로 그 특허가 모두 무효로 되어야 한다’고 주장하였다. 2) 피고는 위 특허무효심판절차에서 2017. 11. 14. 이 사건 특허발명의 청구항 2를 아래 나.
