A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On June 28, 2012, the Defendant was sentenced to a fine of one million won as a crime of violating the Road Traffic Act (drinking driving) in the support of the Sugwon method, and on April 1, 2014, the Defendant was sentenced to a suspended sentence of one year for six months due to a violation of the Road Traffic Act (dacting driving) and a violation of the Road Traffic Act (dacting driving without a license) in the support of Sugwon method.

[Criminal facts]

1. The Defendant is a person engaging in driving of Bunst-Pacific cargo vehicles;

On March 7, 2016, the Defendant driven the foregoing cargo vehicle under the influence of 0.150% alcohol while blood alcohol without a driver's license on March 7, 2016, and had it drive the D church in front of the D church in the Dong-gu C when Ansan City.

It is a place where a road is narrow and there are parking vehicles, so there was a duty of care to provide safe operation and drive safely.

Nevertheless, the Defendant neglected this and caused the collision with the back part of the Defendant’s front driver of the Defendant’s vehicle, which was parked on the left side of the moving direction due to the negligence of driving the vehicle on the left side of the driving direction, and caused the above damaged vehicle to conflict with the victim’s G house crime prevention window due to the shock.

Ultimately, even though the above occupational negligence caused damage to the above-mentioned cargo vehicles and house crime prevention windows, the Defendant immediately stopped and escaped without taking necessary measures.

2. The Defendant: (a) was under the influence of alcohol level of 0.150% during the blood transfusion without a driver’s license in a day-to-day manner as set forth in paragraph (1) of the above paragraph, and (b) was driving the said BMless-Pacific Cargo at the section of approximately 500 meters from the distance of the heat friend in the Dong and the passage of the D church in Ansan-si to the front of the D church in Ansan-si.
