Reasons
Punishment of the crime
1. The Defendants’ crime of occupational embezzlement (2017 senior 2372 senior 201) committed the victim H Co., Ltd. (hereinafter “victim”) was awarded contracts for “I New Apartment Construction Corporation (hereinafter “I”)” and “J New Apartment Construction Corporation (hereinafter “J New Construction Corporation”) respectively from the development of the Vietnam Industry.
In addition, Defendant A was awarded a subcontract for the pelvis and laging construction from among the I New Construction Works subcontracted to Defendant A, and was awarded a subcontract for the pelvis construction among J New Construction Works. Defendant B, as the victim company, worked as the head of the site of each of the above construction works. Defendant C, as a pelle article, performed the work of transporting steel bars at each of the above construction sites.
A. On April 15, 2016, Defendant A received a proposal from Defendant B at the site of the I New Construction Work and requested Defendant C to sell the steel bars, and Defendant C received a request from Defendant C to sell the iron bars. Defendant C consented to the request and sold KRW 4,248,400 (380 won per 1km) with the steel bars, which Defendant B kept in the custody of the victim for the victim’s company, while carrying 1.18 tons of the steel bars, which Defendant B was in the custody of the victim’s company.
As a result, the Defendants conspired and embezzled the said iron bars.
2) On May 8, 2016, at the same construction site around 10:30 on May 8, 2016, the Defendants conspired to sell and embezzled the iron bars 12.57 tons, which Defendant B had been under custody for the victim company, at L, at KRW 4,840,000 (350 won per 1km).
B. On May 28, 2016, the Defendants conspired to commit a crime at the scene of the J-New Construction Corporation (hereinafter “J-New Construction”) and sell in collusion the iron bars 4.75 tons of which Defendant B was under the occupational custody for the victim company by receiving KRW 1.9 million (400 won per 1kg).
