Defendant shall be punished by imprisonment for a term of two years and six months.

Criminal facts

The Defendant is the actual representative of D Co., Ltd. (hereinafter referred to as “D”) which is a construction company for the construction of the officetel new building in Yeongdeungpo-gu Seoul Metropolitan Government. E is the former representative of D and F is the representative of G Co., Ltd. (hereinafter referred to as the above office building) who is the above officetel sales agent, while H is the representative of I (hereinafter referred to as “I”) who is the executor of the above officetel sales business.

However, the building and its site of the above Ctel had been registered in the name of the Korea Asset Trust Co., Ltd. on February 19, 2008. However, even if the above I sold the building and its site under the "Business and Agency Agreement", it was reported to the Korea Asset Trust Co., Ltd., and the sale price should be deposited into the account of the Korea Asset Trust Co., Ltd., and the sale price is recognized and the construction price is paid only through the above account. Thus, the executor or the City Co., Ltd is not entitled to sell the above officetels individually, and in particular, 8 bonds, such as 810, 704, among the 112th office officetels as of November 7, 207, including 112th office officetels, have already been completed, and thus, it was impossible for the executor or the Si Co., Ltd. to transfer its ownership even if it received the money from the victims as the sale price of the above part, and there was no authority to provide the above part as security.

Nevertheless, in collusion with the above E, the defendant used the above officetel sales contract and the sales contract in collusion with H arbitrarily prepared on the side of D to gather money from the victims to use it as the price for the construction, etc.

1. On May 24, 2010, the Defendant, in collusion with the above E, sold the victim’s office at the D office located at the site of the construction of the instant officetel in Yeongdeungpo-gu Seoul Metropolitan Government, to the extent that “C Office 603” is much less than the market price, and the victim will sell it to KRW 200 million.
