The defendant shall be innocent.
Reasons
1. The summary of the facts charged was an architect who vicariously performed on-site investigation, inspection, and confirmation when filing an application for change of building permission for new construction DD located in Jung-gu Seoul Metropolitan Government C.
An architect who vicariously performs on-site surveys, inspections, or confirmations under the Building Act shall report the results of such on-site surveys, inspections, or confirmation to the permitting authority in writing.
Around December 30, 2009, the Defendant prepared a false design at the office of Jung-gu Seoul, Jung-gu, Seoul, Jung-gu, Seoul, about 76, the Han-gu, Seoul, with a view to one meter, even though the remaining ground surface (GL) of the building was zero meters, and the restriction on the height of the building was in conformity with Article 60 of the Building Act, and filed a false report on the building permit, investigation and inspection with the Jung-gu office.
2. According to the evidence duly adopted and examined by this court, the defendant, as a certified architect, was in charge of design change such as adding underground floors to new buildings located in Jung-gu Seoul Metropolitan Government C (hereinafter "the site in this case"), and applied for design change to the Jung-gu Seoul Metropolitan Government Office. The above design drawing is expressed as if the ground surface (GL) of the boundary area (Seoul Jung-gu E) abutting on the south of the site in this case is one meter, and one meter away to the part adjacent to the site in this case. However, the above design drawing is actually expressed as if there is a limit of 1 meter. However, the land surface should have been marked as a slope with a full degree of the boundary abutting on the south of the site in this case. Upon the above design modification application, the Jung-gu Seoul Metropolitan Government Office acting for the defendant through the Building Act, and the defendant prepared a building permit investigation and inspection report on new buildings in this case, and it can be recognized that the above design modification application is acceptable.
