Punishment of the crime

1. On November 15, 2013, the Defendant driven C rocketing car under the influence of alcohol content of about 0.109% in the section of about 9km from around the day near the hotel located in the Mapo-gu Seoul Metropolitan Government, to the front road of the Hongdong 461 Hongdong, Seodaemun-gu, Seoul, Hongdong, about 0.109% in blood alcohol content.

2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is a person engaging in driving a rocketing or other car.

On November 15, 2013, the Defendant driven the above car at around 00:15, and, on the other hand, the Defendant driven the front road of Seodaemun-gu, Seoul, Seodaemun-gu 461 Red-gu, Hongdong apartment in the direction of red street, led to approximately 40 km each hour at a speed of 40 km from the direction of green street to the direction of green street.

At all times, the signal has been transmitted to the front, and the victim D(56 years old) E-si was stopped in order to make a U-turn, so there was a duty of care to prevent accidents by complying with the signal and properly operating the steering gear and brakes.

Nevertheless, under the influence of alcohol, the Defendant was negligent in neglecting the above duty of care while driving in a state where it is difficult to drive under normal conditions, such as rhythm, a state of walking, a snow with red and red inside, and thus, received the victim’s taxi back part of the victim’s taxi in front of the car of the Defendant.

As a result, the defendant suffered injury to the victim by negligence of violating the duty of care in a state where normal driving is difficult due to influence of drinking, such as the climatic salt, which requires treatment for about two weeks.
