The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. The Defendant did not commit an indecent act against the victim F (hereinafter “victim”) as in the facts charged.

The statement of the victim is not consistent and it is difficult to believe that the victim's statement is not consistent, and the closed-circuit (CCTV) video (hereinafter referred to as "video") installed in the soup bank of this case does not constitute an indecent act against the victim.

It is insufficient to recognize the fact that the defendant committed an indecent act against the victim only by other evidence submitted by the prosecutor.

B. The lower court’s sentence is heavy.

2. Determination

A. Comprehensively taking account of the evidence examined in the lower court’s argument of mistake of facts, the following facts and circumstances are recognized.

The facts that the defendant commits an indecent act against the victim may be recognized based on such facts.

1) 피해자는 수사기관, 원심 법정에서 ‘이 사건 찜질방 수면실에서 잠을 자고 있었는데 누군가 제 몸에 이불을 덮고 성기 쪽에 제 손을 갖다 댔습니다. 처음에는 남자친구인줄 알았는데, 계속 그러기에 눈을 떠 보니 다른 사람이 제 옆에 있었습니다. 손을 갖다 댄 건 속옷 안쪽, 바깥 쪽 둘 다 였습니다. 약 10분 정도 지속됐던 것 같습니다. 잠에서 깼을 때 그 사람 찜질방 가운이 풀어헤쳐진 상태였습니다. 저랑 눈을 마주치니 까 아무 일 없었다는 듯이 가운을 여미고 등을 돌려 누웠습니다’(진술서 , '수면실에서 남자친구와 이야기를 하다
