Punishment of the crime

[Basic Facts] Defendant A is a person who entered into an online lottery sales contract with Defendant C, and D operates F convenience points in Daegu-gu E from September 2006 to December 21, 2017. Defendant B is under receipt of the above convenience points from Defendant D on December 22, 2017.

【Criminal Facts】

No person who fails to enter into a contract for the sale of lottery tickets with a lottery business operator on-line shall sell lottery tickets online for profit.

1. Although Defendant A and D's co-principal conduct, D did not enter into a contract for the sale of online lottery tickets from September 2006 to December 21, 2017, and sold online lottery tickets at the above convenience store by using Defendant A's online lottery sales contract. Defendant A agreed to pay KRW 30-4 million per month to D, and then, Defendant A allowed customers who found the above convenience store to sell online lottery tickets for profit.

As a result, Defendant A conspired with D to sell online lottery tickets for profit without concluding a contract on the sale of lottery tickets with lottery business operators.

2. Nevertheless, Defendant A and Defendant B did not enter into a contract for the sale of online lottery tickets, from December 22, 2017 to March 2018, Defendant B sold online lottery tickets with Defendant A’s online lottery sales contract at the convenience store. Defendant A agreed to distribute half of the monthly lottery sales proceeds, and then, Defendant B agreed to sell online lottery tickets for profit to customers who found the convenience store.

Accordingly, the Defendants conspired to sell online lottery tickets for profit without concluding a contract on the sale of lottery tickets with lottery business operators.
